Will the Florida court consider high living expenses such as loan payments and income taxes when determining my ability to pay child support?

Florida courts consider a number of factors when determining child support. One of the primary factors that the court considers is a party's income tax liability and that can be both federal and state income tax liability. However, the Florida courts do not factor in optional or elective expenses that a party might have. The primary reason for that is because a parent's legal duty to support their child takes precedence over expenses that are elective or optional.
